Humanitarian & Compassionate Applications in Canada: When H&C May Matter

Family together in Toronto representing Canadian family sponsorship

Humanitarian and compassionate consideration exists for exceptional situations where applying the normal immigration rules would not adequately address the individual circumstances. It is discretionary, evidence-driven and should not be treated as a general alternative whenever another program is unavailable.

H&C is a whole-case assessment

IRCC can consider the applicant’s circumstances together rather than in isolation. Establishment, family relationships, hardship, health, country conditions and the consequences of removal can all be relevant depending on the facts.

Best interests of children

Where children are directly affected, their best interests are an important consideration. The evidence should explain the child’s actual age, dependency, schooling, health, relationships and likely consequences rather than rely on general statements about children.

Establishment needs evidence

Employment, education, community involvement, tax history, family support and a stable life in Canada can help document establishment. The weight of establishment depends on the broader case.

Hardship is personal and contextual

Country conditions can matter, but the application should connect them to the person’s circumstances. Medical, family, social or economic hardship may require objective records and detailed explanation.

Know the limits

Statutory restrictions can affect whether H&C is available or what can be considered. The application route should be checked before investing in a large evidence package.

Frequently asked questions

Is H&C a guaranteed route for someone without status?

No. It is discretionary and depends on the individual circumstances and legal restrictions.

Do I need children in Canada to make an H&C application?

Not necessarily. Children’s interests are one possible factor, not a universal requirement.

Can H&C stop removal automatically?

Submitting an H&C application does not automatically create a stay of removal. Enforcement and H&C are separate legal processes.
