Spousal sponsorship is relationship-based, but a strong application is not simply a collection of wedding photographs. It should establish the legal relationship category, the genuine history of the couple and the sponsor’s eligibility while addressing any facts that might reasonably concern an officer.
Choose the correct relationship category
Marriage, common-law partnership and conjugal partnership have different legal definitions. Common-law status generally requires at least 12 consecutive months of cohabitation. Conjugal sponsorship is narrower and should not be used simply because a couple has not lived together.
Evidence should tell a relationship story
Useful evidence can include communication, visits, cohabitation, shared finances, children, family involvement, photographs, joint decisions and plans. Quality and chronology are often more useful than hundreds of repetitive screenshots.
Explain periods of separation
Employment, immigration restrictions, family duties or education can cause couples to live apart. Separation does not automatically undermine a relationship, but unexplained gaps can invite questions.
Sponsor eligibility and undertakings
The sponsor must meet the legal requirements and signs a financial undertaking. Previous sponsorships, social assistance, criminal history and other statutory factors can affect eligibility.
Temporary status while sponsorship is pending
A spouse or partner may separately qualify for temporary residence or an open work permit in defined circumstances. Sponsorship itself does not automatically create temporary status.
Frequently asked questions
How many photos should a spousal sponsorship include?
There is no magic number. The evidence should cover the relationship history and important events without becoming repetitive or disorganized.
Can a spouse be sponsored while living in Canada?
Yes, depending on the facts and the processing category. Current status and any open work permit option should be reviewed separately.
What if we were previously refused?
The refusal reasons should be reviewed before reapplying or considering an appeal, because the next step depends on the decision and evidence.
